These Terms of Service (the "Terms") govern your access to and use of Kpop-Swag.com, including any upload, design, proofing, ordering, laser engraving, fulfillment, account, customer support, and related services offered through the website (collectively, the "Service").
By accessing the Service, creating an account, uploading artwork, submitting a design, approving a proof, placing an order, or purchasing any product, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian.
If you use the Service on behalf of a business, organization, fan group, community, or other entity, you represent and warrant that you have authority to bind that entity to these Terms.
Kpop-Swag.com is an independent, fan-focused custom laser engraving service for small-format premium metal goods. Products may include metal photocards, metal key tags, metal charms, metal luggage tags, keychains, and related small keepsake items.
Kpop-Swag.com does not currently offer apparel, paper photocards, plastic photocards, posters, banners, lightsticks, albums, or replica official merchandise.
Products made through Kpop-Swag.com are custom, user-directed, laser-engraved metal goods. They are not official merchandise.
Kpop-Swag.com is independent. Kpop-Swag.com is not affiliated with, associated with, authorized by, endorsed by, sponsored by, licensed by, or officially connected with any K-pop artist, idol, musical group, entertainment agency, record label, concert promoter, venue, tour, fan club, brand, trademark owner, copyright owner, publicity-right holder, or other rights holder.
All artist names, group names, company names, logos, trademarks, service marks, trade dress, images, likenesses, and other intellectual property belong to their respective owners. Any reference to third-party names or properties is for descriptive purposes only and does not imply affiliation, endorsement, sponsorship, authorization, licensing, or approval.
You may need an account to use certain parts of the Service. You agree to provide accurate, current, and complete information and to keep that information updated.
You are responsible for all activity under your account, including uploads, orders, proof approvals, messages, and attempts to bypass product limits. You must not share your account, use another person's account, create fake accounts, or create multiple accounts to bypass these Terms.
Kpop-Swag.com may suspend, restrict, or terminate accounts that violate these Terms, create legal or operational risk, submit prohibited content, attempt to bypass production limits, or misuse the Service.
"Customer Content" means any image, artwork, photograph, illustration, drawing, design, text, name, phrase, slogan, logo, file, reference, layout, instruction, or other material that you upload, submit, email, provide, approve, or ask us to use in connection with the Service or an order.
You remain responsible for your Customer Content. Kpop-Swag.com does not claim ownership of Customer Content that you submit. However, by submitting Customer Content, you grant Kpop-Swag.com a limited, non-exclusive, worldwide, royalty-free license to copy, reproduce, modify, resize, crop, convert, engrave, print, etch, manufacture, display internally, store, preserve, review, and otherwise use the Customer Content solely as needed to operate the Service, process your order, produce proofs, manufacture products, provide support, maintain records, comply with law, respond to rights-holder complaints, enforce these Terms, and defend Kpop-Swag.com.
Kpop-Swag.com acts as a user-directed custom engraving service. You choose, upload, submit, or approve the Customer Content used for your order.
Kpop-Swag.com may make technical adjustments to Customer Content for engraving quality, including resizing, cropping, contrast adjustment, grayscale conversion, line cleanup, vector conversion, file conversion, layout adjustment, and material-specific optimization. These technical adjustments do not mean that Kpop-Swag.com has reviewed, cleared, approved, licensed, or verified the legal rights to the Customer Content.
Our acceptance of an upload, generation of a proof, processing of payment, production of an item, or shipment of an order does not mean that Kpop-Swag.com has verified your rights or approved the legality of your Customer Content.
You remain solely responsible for your Customer Content, your order, your proof approval, your use of the finished products, and any claims arising from them.
Kpop-Swag.com is intended to support personal fan collecting, fan-to-fan trading, free fan giveaways, and non-commercial fan community activities.
The Service is not intended for commercial merchandising, mass production, unauthorized retail sales, resale inventory, fundraising merchandise, influencer monetization, or any use that could imply official merchandise or official authorization.
Kpop-Swag.com products are clearly labeled and positioned as non-official custom fan-made metal goods. This does not mean that all Customer Content is automatically lawful. You are still responsible for having all required rights and permissions for the artwork, names, likenesses, logos, phrases, references, and other content that you submit.
By uploading Customer Content or placing an order, you represent and warrant that the ordered items are intended only for:
You may not sell, resell, auction, list, monetize, bundle with paid goods, include as a paid membership perk, use for fundraising, use for influencer monetization, distribute through retail channels, or otherwise use Kpop-Swag.com products for commercial or profit-generating purposes.
To preserve the non-commercial fan community purpose of the Service and prevent unauthorized mass production or resale, Kpop-Swag.com enforces a strict production limit of no more than thirty (30) physical items per specific design per user order.
This limit applies to all product types, including metal photocards, metal key tags, metal charms, metal luggage tags, keychains, and any other custom metal goods.
A "specific design" means the same or substantially similar artwork, file, image, layout, text, character, idol likeness, group reference, logo, phrase, or visual concept, even if minor changes are made to color, size, crop, border, finish, product type, file format, wording, placement, or engraving settings.
You may not bypass or attempt to bypass the 30-item limit by:
Any attempt to avoid the production cap is a material breach of these Terms and may result in order cancellation, refusal of production, account suspension, account termination, rejection of future orders, and preservation of records for legal, operational, rights-holder, chargeback, fraud-prevention, or dispute-resolution purposes.
Kpop-Swag.com may cancel or refuse any order that appears to be commercial, mass-produced, coordinated, duplicative, automated, or inconsistent with these Terms.
Kpop-Swag.com does not produce apparel or standard official-style merchandise at this time.
You may not use the Service to create products that copy, imitate, or could reasonably be confused with official merchandise, including official photocards, tour goods, album inclusions, agency merchandise, concert goods, official logos, official typography, official layout systems, official packaging, ticket designs, membership goods, or fan-club goods.
Kpop-Swag.com may reject or cancel any order that appears to imitate official merchandise or create a risk of consumer confusion.
To preserve the distinction between custom fan-created metal goods and official merchandise, Kpop-Swag.com may apply a small permanent marking to the reverse side, edge, border, or template area of each item.
This marking may include language such as:
You agree that Kpop-Swag.com may include this marking as part of the production process. The marking may be micro-engraved, etched, printed, or otherwise incorporated into the final item depending on the product type and production method.
Kpop-Swag.com may reject requests to remove this marking where we believe the marking is necessary to reduce confusion, prevent resale, preserve the non-commercial nature of the product, or protect Kpop-Swag.com, customers, artists, rights holders, or the fan community.
By uploading Customer Content, approving a proof, or placing an order, you represent and warrant that:

Original fan-created artwork may still require permission depending on what it depicts and how it is used. Kpop-Swag.com may reject or cancel any order that appears to create copyright, trademark, publicity-right, privacy, resale, consumer-confusion, reputational, safety, or other legal risk.
You are responsible for reviewing all proofs, previews, spelling, names, dates, layout, image quality, cropping, alignment, product options, quantities, shipping information, and design details before approving an order.
Once you approve a proof or submit final artwork, you authorize Kpop-Swag.com to produce the product. Custom products may not be cancelable or refundable after production begins.
Kpop-Swag.com may reject, cancel, pause, or refuse any order at any time if we believe the order may violate these Terms, create legal risk, create production risk, create reputational risk, or harm Kpop-Swag.com, customers, artists, rights holders, or third parties. We are not required to make a legal determination before refusing an order.
Prices are listed on the website or quoted during the ordering process. Prices may change at any time before an order is placed.
You agree to pay all charges associated with your order, including product charges, customization charges, shipping charges, taxes, and any other fees shown at checkout.
You represent that you are authorized to use the payment method provided. Kpop-Swag.com may cancel or suspend an order if payment is declined, reversed, disputed, flagged as suspicious, or subject to a chargeback.
You are responsible for any applicable taxes, customs duties, import fees, or local charges, unless they are expressly included at checkout.
Shipping timelines are estimates and are not guaranteed unless expressly stated in writing. Production time and shipping time may vary based on order volume, proof approval timing, material availability, carrier delays, customs delays, weather, holidays, and other factors outside Kpop-Swag.com's control.
Risk of loss passes to you when the order is delivered to the shipping carrier, to the extent permitted by law. Kpop-Swag.com is not responsible for carrier delays, lost packages, stolen packages, incorrect addresses, customs delays, or delivery issues outside our control.
You are responsible for providing a complete and accurate shipping address. Additional charges may apply for reshipment, address correction, returned packages, or failed delivery.
Because Kpop-Swag.com products are custom-made, orders may be non-refundable once production begins.
Kpop-Swag.com may provide refunds, replacements, store credit, or rework at our discretion for confirmed production defects, material defects, or order errors caused by Kpop-Swag.com.
Kpop-Swag.com is not responsible for errors in Customer Content, low-resolution images, spelling mistakes, layout choices, user-approved proofs, incorrect quantities, incorrect addresses, rights-related cancellations, or changes requested after production begins.
If an order is paused or canceled because of an intellectual property concern, rights-holder complaint, suspected resale, suspected cap circumvention, or other legal risk, Kpop-Swag.com may request proof of rights, permission, or authorization. Kpop-Swag.com may cancel the order if you do not provide satisfactory proof.
Kpop-Swag.com respects artists, creators, photographers, designers, agencies, labels, brands, and other rights holders.

Upon receiving a valid notice or credible rights-holder complaint, Kpop-Swag.com may, without prior notice to the customer, pause production, cancel an order, disable access to uploaded files, remove disputed content, block future processing of disputed assets, suspend accounts, refund or refuse orders, and preserve relevant records.
If Kpop-Swag.com stores user-uploaded material online or otherwise qualifies as a service provider under the Digital Millennium Copyright Act, Kpop-Swag.com intends to respond to copyright notices in accordance with applicable law.
To request removal or disabling of access to material under the DMCA, send a written notice to the Designated IP Agent listed above. The notice should include the information required by 17 U.S.C. 512(c)(3), including identification of the copyrighted work, identification of the material claimed to be infringing, your contact information, a good-faith statement, an accuracy and authorization statement under penalty of perjury, and a physical or electronic signature.
Kpop-Swag.com may remove or disable access to material that is claimed to be infringing or that appears to create copyright risk. Kpop-Swag.com may also terminate or restrict accounts of users who are repeat infringers in appropriate circumstances.
If Kpop-Swag.com receives a counter-notification that complies with applicable law, Kpop-Swag.com may follow the statutory counter-notification process where required.

Kpop-Swag.com may terminate, suspend, restrict, or refuse service to users who repeatedly submit infringing, suspicious, high-risk, prohibited, or rights-holder-disputed content.
Kpop-Swag.com may also refuse future orders from users who attempt to bypass the 30-item cap, submit repeated variations of prohibited content, ignore rights-holder complaints, provide false rights confirmations, provide false non-commercial-use confirmations, or otherwise create legal, operational, payment, fraud, or reputational risk.
Kpop-Swag.com is not your attorney and does not provide legal advice. Kpop-Swag.com does not verify ownership, licensing, clearance, fair use, publicity rights, trademark rights, copyright rights, venue policies, fan-club policies, or permissions for Customer Content.
You are solely responsible for determining whether your Customer Content and intended use are lawful. In cases of doubt, obtain written permission from the rights holder before uploading or ordering.
You agree to indemnify, defend, and hold harmless Kpop-Swag.com, [Northlight Studios], and our owners, officers, directors, employees, contractors, vendors, suppliers, manufacturers, fulfillment partners, payment processors, affiliates, agents, successors, and assigns from and against any and all claims, demands, allegations, notices, takedown requests, lawsuits, proceedings, investigations, liabilities, damages, losses, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees and court costs, arising out of or related to:
Your duty to defend applies immediately upon written notice from Kpop-Swag.com, even if the claim is groundless, false, fraudulent, or ultimately unsuccessful. Kpop-Swag.com may choose its own legal counsel and may participate in the defense at your expense where a conflict of interest exists, where you fail to promptly assume the defense, or where Kpop-Swag.com reasonably determines that separate counsel is necessary to protect its interests.
You may not settle any claim in a way that admits fault by Kpop-Swag.com, imposes obligations on Kpop-Swag.com, restricts Kpop-Swag.com's business, requires payment by Kpop-Swag.com, or affects Kpop-Swag.com's rights without our prior written consent.
This indemnity obligation survives completion of your order, delivery of products, account termination, cancellation, chargeback, refund, or termination of these Terms.
To the fullest extent permitted by law, the Service and products are provided "as is" and "as available," except as expressly stated in writing.
Kpop-Swag.com disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, error-free operation, and that any Customer Content or finished product is legally cleared, non-infringing, or safe to use.
Kpop-Swag.com does not warrant that the Service will be uninterrupted, secure, accurate, complete, available, or free of errors, viruses, or harmful components.
Some jurisdictions do not allow disclaimers of certain warranties, so some disclaimers may not apply to you.
To the fullest extent permitted by law, Kpop-Swag.com, [Northlight Studios], and our owners, officers, directors, employees, contractors, vendors, suppliers, manufacturers, fulfillment partners, payment processors, affiliates, agents, successors, and assigns will not be liable for any indirect, incidental, consequential, special, exemplary, enhanced, or punitive damages, including lost profits, lost revenue, lost business opportunities, lost data, business interruption, reputational harm, loss of goodwill, replacement costs, or legal exposure arising from Customer Content.
To the fullest extent permitted by law, Kpop-Swag.com's total cumulative liability for any claim arising out of or related to the Service, Customer Content, a product, or an order will not exceed the amount you paid to Kpop-Swag.com for the specific order giving rise to the claim.
If no purchase was made, Kpop-Swag.com's total cumulative liability for any claim arising out of or related to the Service will not exceed one hundred dollars ($100).
The limitations in this section apply to all claims, whether based on contract, tort, negligence, strict liability, warranty, statute, equity, or any other legal theory, even if Kpop-Swag.com has been advised of the possibility of such damages and even if a limited remedy fails of its essential purpose.

Kpop-Swag.com will not be liable for delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, severe weather, labor disputes, supply shortages, carrier delays, customs delays, power failures, internet failures, equipment failures, cyberattacks, payment processor outages, government action, war, terrorism, civil unrest, public health emergencies, or other events outside our reasonable control.

You agree that Kpop-Swag.com may contact you by email, website message, account notification, SMS, or other contact method you provide regarding your account, uploads, proofs, orders, rights issues, payments, shipping, support, policy updates, or legal notices.
The Service may use third-party services, including payment processors, shipping carriers, analytics providers, hosting providers, design tools, manufacturing vendors, and support tools. Kpop-Swag.com is not responsible for third-party services, websites, policies, delays, errors, or outages.
Your use of third-party services may be subject to their separate terms and policies.
Kpop-Swag.com may modify, suspend, discontinue, or limit any part of the Service at any time, including product types, materials, production limits, upload features, proofing workflows, payment options, shipping options, and account features.
Kpop-Swag.com may update these Terms from time to time. The updated version will be posted on Kpop-Swag.com with a revised "Last updated" date.
Your continued use of the Service after updated Terms are posted means you accept the updated Terms. If you do not agree to updated Terms, stop using the Service.
